JUSTICE ARUN KUMAR ORAL ORDER 26-06-2018 Heard learned Counsel for the petitioner and the learned Counsel for the State.

Petitioner, already in custody since 3.4.2018, seeks bail in Vigilance PS Case No. 12 of 2018, Special Case No. 17 of 2018, registered under Sections 7/13(ii) and 13(i)(d) of the P.C.Act. The allegation in brief is that eighteen thousand rupees was demanded by the petitioner (Halka Karmchari) as illegal gratification from the complainant for issuing rent receipt for the year 2017 and caught by the Vigilance in the trap.

Submission is that there was no occasion for demanding any illegal gratification for issuing rent receipt as there was already mutation in the name of the complainant and rent receipt was already issued till 2016, the petitioner had joined recently in Febr uary 2018 and finding some irregularities in the official transaction committed by his predecessor filed complaint against him so at his behest the petitioner was falsely implicated, moreover the complainant had also filed an application fore the Circle Officer for issuing rent receipt and that was still pending before him and charge-sheet has been submitted in this case.

No.34252 of 2018 (2) dt.26-06-2018 Having considered the said facts and circumstances, the petitioner Puranjay Ojha is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Vigilance I, Patna in connection with Vigilance PS Case No. 12 of 2018, Special Case No. 17 of 2018.
