Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Hathauri P.S. Case No. 38 of 2021 lodged under Sections 302, 201 and 34 of the I.P.C.

As per the prosecution case, the father of the informant went for some purchase and about 4 pm, an auto ricksaw stopped at the door of the informant and the dead body of his father was thrown at his door by the accused persons. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 04.05.2022. He also

Patna High Court CR. MISC. No.56765 of 2022(3) dt.24-02-2023 2/2 submits that this Court has pleased to grant bail to the other two accused persons in Cr. Misc. No. 19940 of 2022, which is Annexure-3.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.-1st Class, Muzaffarpur in connection with Hathauri P.S. Case No. 38 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
