Learned counsel for the petitioner is permitted to remove the defect(s), as pointed out by the office, if any, within a period of four weeks from today.
The petitioner seeks pre-arrest bail in connection with Garkha P.S. Case No. 354 of 2021 lodged under Sections 341, 323, 324, 307, 354(B), 504, 379/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner and informant side are Gotiya. Learned counsel further submits that from the F.I.R. itself, it transpires that dispute between the parties are relating to measurement of land and opening of door. He further submits that there is no specific allegation against the petitioner, rather, there is a general and

A general and omnibus allegation is upon the petitioner that he along with two others inclined to attack to the mother of the informant. He further submits that the petitioner having clean antecedent. Learned A.P.P. for the State submits that it is true that there is no specific allegation either of Section 307 or Section 354(B) is there in the F.I.R. against the petitioner.
Considering the facts and circumstances of the case and also considering that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned court below within a period of four weeks from today, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saran at Chapra in connection with Garkha P.S. Case No. 354 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
