2. The petitioner seeks bail in connection with Nagar P.S. Case No. 40 of 2024 registered for the offence under Sections 307, 326, 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, one Chotu Poddar and Pritam Kumar were killed by unknown criminals.

4. During investigation, it has come that the petitioner has participated in the killing of both the deceased and he is the assailant of Chotu Poddar.

5. In view of the serious allegations of double murder, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this application is dismissed.

No.67503 of 2024(2) dt.03-10-2024 2/2 brought to the notice of this Court by the learned counsel for the informant that it is a case of double murder and materials are also available against the accused persons but the Court below (ADJ-IV, Katihar, Shri Anil Ram) had granted anticipatory bail to the other co-accused namely Md. Hasan Khan @ Tinku in ABP No. 580 of 2024, Azad Alam @ Md. Azad @Azad Army in ABP No. 641 of 2024 and Md. Akil @ Chand Hasmi in ABP No. 643 of 2024.

8. Taking into consideration the aforesaid submission of the learned counsel for the informant, call for the records of the aforesaid anticipatory bail petitions from the District Judge, Katihar.

9. List this case on 21.10.2024 for further orders.
