JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 323, 341 and 307/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The prosecution case is that co-accused Ramanand Prasad came to the shop of the informant and purchased some betel and on the demand of price the accused persons abused and assaulted the informant when the informant was taken to Primary Health Centre and later on the informant succumbed to the injuries.

It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner and

No.41719 of 2015 (2) dt.14-10-2015 2/2 postmortem report reflects no external injury rather postmortem report reflects presence of alcohol in the stomach of the deceased and considering the same other co-accused have been granted regular bail vide Cr. Misc. No. 18607 of 2015. This Court finds no reason for the learned court below not to consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Chandi P.S. Case No. 277 of 2014 pending in the court of learned CJM, Nalanda.

Accordingly, the application is disposed of.
