The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 448, 427, 506 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the accused persons came to the door of the informant, dismantled the pillar fixed on the land in question and abused the informant by calling caste name. The accused persons pelted bricks and stones
Patna High Court Cr.Misc. No.41198 of 2015 (2) dt.07-10-2015 2/2 damaging the mud roof tiles of the house of the informant. It is submitted by learned counsel for the petitioners that in the background of serious land dispute the accusation has been levelled as 107 and 144 Cr.P.C. were initiated between the parties and title suit is also pending between the parties since long. There is a counter version of the occurrence and petitioners' side have also received injuries. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.
10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Sadar Hajipur P.S. Case No. 337 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
