Vide order dated 24.08.2022 passed in Cr. Misc. No. 58533 of 2021, the petitioner was granted anticipatory bail with a direction to deposit Rs.3,000/- in the account of the informant w.e.f. August, 2022 and he will surrender before the learned court below within a period of four weeks with receipt of Rs.3,000/- deposited in the account of the informant, but as submitted, the informant did not provide her account number as a result, the petitioner failed to deposit the said amount in her account.
In this regard, the learned counsel for the petitioner
Patna High Court CR. MISC. No.66957 of 2022(2) dt.30-11-2022 2/2 has filed the instant modification application stating that due to non-availability of account number, the petitioner could not deposit the amount in her account and thereafter surrender before the court below.
In view of the aforesaid facts and circumstances, the informant is directed to provide her bank account number immediately to the petitioner so that he would be able to deposit the amount in her account and with the said receipt, surrender before the court below within a period of four weeks. Let the petitioner surrender before the court below and furnish bail bond within a period of four weeks from the date of this order in connection with Araria Mahila P.S. Case No. 84 of 2021 pending in the Court of learned ACJM-V, Araria and remaining parts of the said order shall remain intact. Accordingly, this modification petition is allowed.
