JUSTICE SUDHIR SINGH ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 332, 353, 504 and 506 of the Indian Penal Code.

Prosecution case, in brief, is that informant, a police constable, was posted at the gate of Civil Court, Araria and he, as per instruction, did not allow petitioner with his vehicle inside the court. On this, petitioner abused, assaulted and threatened him. It has been submitted on behalf of petitioner that he is in custody since 13.8.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. There is no substantive evidence against petitioner to suggest his implication in the present case. On behalf of the State, it is submitted that the entire occurrence had taken place inside the premises of the civil court. Petitioner has got as many as 15 cases pending against him.
