The petitioner has preferred this application for grant of regular bail in a case registered under sections 354A, 354B, 341, 323 and 34 of the Indian Penal Code and sections 8 and 12 of the POCSO Act.

As per the prosecution case, the three named accused persons including the petitioner herein are said to have misbehaved and sexually harassed the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegation of eve-teasing and molesting the minor daughter of the informant is false and concocted. The petitioner is in custody since 8.10.2021 and has no criminal antecedent. Chargesheet

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the petitioner having remained in custody for more than 7 months, chargesheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with POCSO Case no.12 of 2021 (arising out of Tekari P.S. Case no.32 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge (POCSO)- cum-Additional District Judge VII, Gaya.
