Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Nokha P.S. Case No. 246 of 2021 lodged under Sections 341, 323, 324, 325, 307, 504, 506/ 34 of the I.P.C. As per the prosecution case, the F.I.R. has been lodged against 9 named accused persons including the present petitioner. There are specific allegation in this case against 3 persons, namely, Hanuman Ram, Jageshwar Ram (petitioner) and Dharmendra Kumar who attacked by iron rod on the body of son of the informant by which bleeding started. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.62908 of 2022(2) dt.22-02-2023 2/3 antecedent of the petitioner is clean and he is in custody since 09.01.2022. Counsel further submits that the other 2 accused persons having same allegation and have been granted bail by the Co-ordinate Bench of this Court vide order dated 02.08.2022 and 26.08.2022 passed in Cr. Misc. No. 20895 of 2022 and Cr. Misc. No. 26694 of 2022 respectively.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned 18th Additional Sessions Judge - Rohtas at Sasaram in connection with Nokha P.S. Case No. 246 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. with other following conditions: A. The petitioner shall support in trial and shall appear physically before the lower court on each and every date fixed, in case of non-appearance for two consecutive dates without sufficient cause, shall be resulted into cancellation of his bail bond.
