ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.07.2019 in connection with Special Case No.6269 of 2019 arising out of Jakkanpur P.S. Case No.440 of 2019 registered for the offence under Sections 273 and 290 of the Indian Penal Code and Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the Khatal. It is further submitted that since the alleged recoveries were not from his conscious possession, the petitioner may be extended the privilege of bail.

Considering the aforementioned facts and

No.54599 of 2019(2) dt.04-09-2019 2/2 circumstances and that the petitioner has got no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No.6269 of 2019 arising out of Jakkanpur P.S. Case No.440 of 2019.
