JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Learned counsel for the petitioners informs that petitioner no. 3, namely, Mosmi Jha @ Mausham Jha, has been arrested during the pendency of this anticipatory bail application.

In view of the above, this application to the extent it relates to petitioner no. 3 stands dismissed as having become infructuous.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioner nos. 1, namely, Narayan Jha and 2, namely, Tunay Sharma, seek anticipatory bail in a case registered for the offences punishable under Sections 341, 323, 448, 354 and 379/34 of the Indian Penal Code.

No.46797 of 2014 (2) dt.07-05-2015 2/2 Learned counsel appearing on behalf of the petitioners appears to be right in his submission that there is no specific allegation of any assault so far as these two petitioners are concerned, though such allegation is there against one Ajay Jha @ Munna Jha.

It is stated in Paragraph No. 3 of the application that petitioners have got no criminal antecedent. In view of the submission as above, let the petitioner nos. 1 and 2, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 676 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
