1. Heard learned counsel for the petitioners and learned APP for the State.
2. The learned counsel for the petitioners, after arguing vehemently for sometimes realizing his difficulty, seeks permission to withdraw the present anticipatory bail application with respect to petitioner no.1, namely, Tajibur Rahman.
3. Permission is accorded.
4. Accordingly, instant petition is dismissed as withdrawn with respect to petitioner no.1, namely, Tajibur Rahman.
5. The petitioner no.2 seeks bail in anticipation of his arrest in a case registered for the offences punishable under
Patna High Court CR. MISC. No.64408 of 2025(2) dt.25-09-2025 2/3 Sections 126(2), 115(2), 117(2), 351(2), 352, 303(2), 3(5), 109 of the B.N.S.

The learned counsel for the petitioner submits that the petitioner no.2 is a person with clean antecedent and the informant alleges that on account of dispute relating to harvesting of maize crop from the field of Sahabuddin, the accused Tajibur assaulted his brother by an iron rod causing injury on head and near his eye, while Sahabuddin also assaulted his brother and informant by bamboo and Matibur took Rs.7500/-.

The learned counsel for the petitioner submits that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to harvesting of maize crop, the occurrence is alleged to have taken place. It is next submitted that specific allegation of assaulting the brother of the informant is against Tajibur, who sustained grievous injury.
8. Learned A.P.P. opposes the anticipatory bail application.
9. Considering the submissions made by the learned counsel for the petitioner, the petitioner no.2, above-named, in the event of his arrest or surrender before the learned Court
Patna High Court CR. MISC. No.64408 of 2025(2) dt.25-09-2025 3/3 below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P. S. Case No.264 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
