ANJANA MISHRA ORAL ORDER 10-08-2017 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Bihar P.S. Case No.421 of 2015 for allegedly having committed the offence under Section 302/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that in the present case, the specific allegation is against one Raju Ram and at best, the petitioners can be said to be the members of the mob. Admittedly, there was no enmity between the petitioners and the deceased.
Considering the nature of allegations made and the
Patna High Court Cr.Misc. No.35506 of 2017 (2) dt.10-08-2017 2/2 role assigned to these two petitioners, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of `10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Bihar P.S. Case No.421 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
