1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Koilwar PS Case No. 133 of 2021 dated 31.03.2021 registered under Sections 147, 148, 149, 341, 323, 386, 387, 307, 406 of the IPC and Section 27 of the Arms Act.
3. As per the First Information Report lodged by the Police Officer firing was being exchanged between three groups namely, Uma Shankar Rai group, Satendra Pandey group and Bali group at the place of occurrence in order to show their supremacy for the purpose of illegal mining of sand near the place of occurrence. The petitioner has been found to be a member of one of the groups and in the firing resorted to among three groups one person i.e. driver -cum- owner of a tractor has sustained bullet injury. The Police has named 38 persons as
Patna High Court CR. MISC. No.61277 of 2023(2) dt.17-10-2023 2/3 accused including the petitioner in the FIR along with 20-25 unknown persons.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case due to the fact that petitioner used to object the persons indulged in illegal mining of sand from his raiyati land. The petitioner is the owner of the land situated at Kamaluchak and on the basis of the information given to the Mining Officer by his father, the Mining Officer has also lodged an FIR bearing Koilwar PS Case No. 478 of 2020. The father of the petitioner has also lodged an FIR in this regard bearing Koilwar PS Case No. 32 of 2021 dated 26/01/2021. The allegation against the petitioner is general and omnibus in nature and similarly situated co-accused persons have been extended the privilege of anticipatory bail by different Co-ordinate Benches of this Court by order dated: 25-04-2022 passed in Cr. Misc. No. 57937 of 2021 [Annexure6], order dated: 05-04-2023 in Cr. Misc. No. 66243 of 2022 [Annexure- 7] and in Cr. Misc. No. 9542 / 2022 by order dated 02/08/2022.
5. Regard being had to the submission made by the parties, taking into consideration the generality of the allegation made against petitioner and the fact similarly situated accused
Patna High Court CR. MISC. No.61277 of 2023(2) dt.17-10-2023 3/3 persons have been granted anticipatory bail by different Coordinate Benches of this Court, as such, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Bhojpur, Ara in connection with Koilwar PS Case No. 133 of 2021 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
