JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 498-A, 307 and 326/34 of the Indian Penal Code. Petitioner is the husband of the deceased. Allegation is that in-laws of the family put sister of the informant on fire due to domestic dispute and torture.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 22.5.2015. Chargesheet has been submitted in the case under Section 306 of the Indian Penal Code. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. The alleged occurrence is said to have taken place after 17 years of marriage. The petitioner and the deceased were separate in mess. Petitioner is named merely on suspicion. There is no direct or indirect evidence against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

No.41722 of 2015 (3) dt.15-10-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura, in connection with Sheikhpura (Hathiyawan) P.S. Case no. 141 of 2014.
