Petitioner, already in custody, seeks bail in connection with N.D.P.S. Case No. 47 of 2016, arising out of Raxaul P.S. Case No.175 of 2016 registered under Sections 20, 22, 23 and 24 of the N.D.P.S. Act.
Earlier the prayer of the bail of the petitioner was rejected on merit without any observation. Now the petitioner seeks bail on the ground of incarceration in custody since 17.08.2016 and the recovery is 10 gms. of heroin and 82 gms. of opium, less than the commercial quantity.
The learned counsel for the State submits that the trial appears at the fag end as the report of the trial court indicates
Patna High Court Cr.Misc. No.32884 of 2018(3) dt.20-07-2018 2/2 that only two witnesses remain to be examined.
