The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272,273 and 290 of the Indian Penal Code and section 47(a) of the Excise Act. The prosecution case is that 140 liters of country made liquor was recovered from an autorickshaw when the name of one Bhanu Kumar Choudhary was written on the container, FIR was registered against the auto driver, owner and one Bhanu Choudhary. During investigation, it transpired that two persons escaped from the auto rickshaw, one of them being the petitioner. It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general. Statement

Patna High Court Cr.Misc. No.41720 of 2015 (2) dt.09-10-2015 2/2 has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Jagdishpur P.S. Case No. 23 of 2015 pending in the court of learned JM Ist Class, Bhojpur at Ara. This application is disposed of with the aforesaid observation/direction.
