JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 324/307/34 of the Indian Penal Code and Sections 25(1-b)A/26/27/35 of the Arms Act. Two unknown person allegedly fired causing injury at the chest of the son of the informant. When son of the informant was being carried to the hospital, he stated to the informant that co-accused Hari Shankar Jha and unknown person had fired at him.

Submission of the petitioner is that Hari Shankar Jha confessed before the police and stated that the fire-arm was supplied by the petitioner. Petitioner is in custody since

Considering the nature of allegation against the petitioner and the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/Successor Court, in connection with Bahadurpur P.S. Case No.238 of 2016.
