The petitioner apprehends his arrest in Baheri P.S. Case No.285 of 2014 registered under Sections 353 and other Sections of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Properties Act, 1984.

The Circle Officer, Baheri, alleged that the petitioner and others incited the mob, raised Slogans against the Officers, ransacked the Block Office and also damaged public properties. It is submitted that the two cases bearing Baheri P.S. Case No. 284 of 2016 and Baheri P.S. Case No. 286 of 2014 were registered. The present one as Baheri P.S. Case No. 284 of 2014 was lodged by the Circle Officer and the Block Development Officer respectively, on the same and similar allegation. The petitioner was arrested in Baheri P.S. Case No. 284 of 2014, but

Patna High Court Cr.Misc. No.48742 of 2016 (2) dt.15-12-2016 2/2 he was not remanded in this case. On same and similar allegation, co-accused Kumud Ranjan Ram @ Kumud Ranjan has been granted anticipatory bail vide order dated 14.7.2016 passed by this Court in Cr. Misc. 16837 of 2016.

Considering the facts aforesaid, the above named petitioners, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga, in connection with Baheri P.S. Case No. 285 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
