JUSTICE BIRENDRA KUMAR ORAL ORDER 22-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in connection with Amdabad P.S. Case No.86 of 2017 registered for the offences punishable under Sections 341/323 /325 / 307 /504 / 506/34 of the Indian Penal Code, pending in the Court of Mr. Dharmendra Singh, Judicial Magistrate, 1st Class, Katihar. Both the petitioners have allegedly caused injury at the head of the referred injured. The doctor had found head injury, however, simple in nature.

Submission of the learned counsel for the petitioners is that there is case and counter case. There is land dispute between the two family members and other co-accused

Patna High Court Cr.Misc. No.42824 of 2017 (2) dt.22-09-2017 P2/ had already been allowed anticipatory bail by some other coordinate Bench of this Court.

Considering the fact that the petitioners had knowledge that their act might cause death, I am not inclined to grant anticipatory bail to the petitioners. Hence, the prayer for anticipatory bail is refused.
