The present modification application has been filed for modification of the order dated 24.08.2022 passed in Cr. Misc. No.18431 of 2022.

Learned counsel for the petitioner submits that vide order dated 24.08.2022, earlier the petitioner was granted regular bail. Learned counsel for the petitioner submits that one of the conditions stipulated in the bail order was that one of the bailors shall be the father of the victim girl, who is informant, namely, Shambhu Das, of this case. Learned counsel for the petitioner submits that the informant has left the village alongwith his family.

Patna High Court CR. MISC. No.60599 of 2022(3) dt.11-01-2023 2/2 Vide order dated 16.11.2022 a report was called for with regard to the amendment in the modification application. Report dated 02.01.2023 reveals that the informant of this case has already died four months ago, and, hence, the amendment modification petition is correct.

Having regard to the submission made by the petitioner, the present modification petition is disposed of with the observation that condition No.3 enumerated in the order dated 24.08.2022 passed in Cr. Misc. No.18431 of 2022 stands modified to the extent that one of the bailors shall be the father of the petitioner.

Accordingly, this modification application stands disposed of.
