The petitioner was found riding a motorcycle driven by another co accused. On a search, one bottle Nepali wine each is said to have been recovered from the possession of the co-accused Saroj Kumar Jha as well as the petitioner. Another one bottle of wine/liquor was also found kept in the dickey. The contention of the petitioner is that he has no criminal antecedents and is lodged in custody since 12.07.2016. The charge sheet has already been submitted. Referring to Anenxure-2, it is stated that co-accused Saroj Kumar Jha who was driving the motorcycle has been granted bail under order dated 06.10.2016. Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on

Patna High Court Cr.Misc. No.48409 of 2016 (2) dt.26-11-2016 2/2 furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction Sri Samim Raza, Judicial Magistrate 1st Class, Darbhanga in Kamtaul P.S. Case No. 117 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates the trial court shall cancel his bail bonds and secure his arrest in accordance with law.
