1. Though, the present petition has been filed for considering the case of the petitioners to the effect that he is not an encroacher of the government land, which is neither a drain nor ahar, situated at village Gafurichak, Thana No.213, appertaining to Khesra No.1, 2, 31, 39, 50, 171, 172, 201 and at Mauza Kajichak Thana No.212, appertaining to Khesra No.374, 502, 503, 504, 690, 454 and in fact the same is the Khatiyani land of the petitioners, however, at the outset, the learned counsel for the petitioners seeks liberty on behalf of the petitioners to challenge the final order dated 27.06.2023, passed by the Circle Officer, Masaurhi, in connection with Encroachment Case No.01 of 2021-22, under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, by filing appropriate appeal under Section 11 of the Bihar Public Land Encroachment Act, 1956 and during the interregnum period seeks some protection. Liberty so sought is granted.

2. It is needless to state that for a period of four weeks

Patna High Court CWJC No.12811 of 2023(5) dt.24-09-2024 3/3 from today, no coercive action shall be taken against the petitioners in order to enable them to file appropriate appeal and seek interim relief.
