Petitioner seeks bail in connection with Raxaul P.S. Case No. 72 of 2016 registered under Sections- 420, 379/34 of the Indian Penal Code.

It is alleged that a Bank Draft of Rs. 25,00,000/- in the name of Yuk Trading Company, proprietor Mr. Ravi Goel was given to this petitioner. The draft was cleared/encashed by the Raxaul Branch of SBI. Petitioner and Ravi Goel and some other have cheated the informant.

Learned counsel for the petitioner submits that the draft in question was in the name of Yuk Trading Company and the same was encahsed by Mr. Ravi Goel, proprietor of the

Patna High Court Cr.Misc. No.49511 of 2016 (3) dt.08-02-2017 2/2 aforesaid company, as would be evident from the bank statement. Petitioner has no concern with the aforesaid occurrence.

Learned Addl. P.P. appearing for the State opposes the prayer for bail.

Considering the facts and circumstances of the case, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected. However, petitioner may renew his prayer for bail after framing of charge.
