The petitioner apprehends his arrest in Dinara P.S. Case No. 162 of 2016 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and under Sections 54 and 57 of the Bihar Excise Act, 2016.
The informant, police officer, alleged that he got information that in the house of Mithilesh Singh situated in Dinara Bazar, Chandan Sah was selling country made liquor and on such information, the informant raided the house and see Chandan Sah fleeing away from the place of occurrence.
Learned counsel for the petitioner submits that the house was of Mithilesh Singh from where 305 bottles each containing 200 ml of the country made liquor was recovered. The
Patna High Court Cr.Misc. No.48341 of 2016 (3) dt.16-01-2017 2/2 petitioner is not at all concerned with the liquor business of Mithilesh Singh. No chit of paper is filed to show that the petitioner was running the shop. The house from which the liquor was recovered belongs to Mithilesh Singh.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Bikramganj, Rohtas in Dinara P.S. Case No. 162 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
