2. The petitioner has preferred this application for grant of regular bail in connection with Kesariya P.S. Case No. 136 of 2024 dated 06.05.2024 registered for the offences punishable under Sections 366A read with Section 34 of the I.P.C. and Sections 8, 12 of POCSO Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have kidnapped the minor daughter of the informant and on protest by the daughter-in-law of the informant, the petitioner and the co-accused, Dilip Kumar assaulted her and the co-accused namely Dablu Kumar snatched

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There was love affair between the petitioner and the victim. Learned counsel has further submitted that there is nothing on record which shows that the victim was forced to have illicit relationship with another person. The informant's daughter was recovered and her statement was recorded under Section 164 of the Cr.P.C. in which she has stated her age as 19 years old and she eloped with the petitioner on her own sweet will and went to Kerala where they got married. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.02.2025. The co-accused person has already been granted anticipatory bail by the Co-ordinate Bench of this Court vide order dated 11.04.2025 passed in Cr. Misc. No. 1434 of 2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that as per the school certificate, the victim is a minor girl aged about 16 to 17 years.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-

No.62906 of 2025(2) dt.22-09-2025 3/3 named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran, Motihari in connection with Kesariya P.S. Case No. 136 of 2024.

7. The application stands allowed.
