JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,323,307 and 302 of the Indian Penal Code and section 3(2)(v) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

It is alleged that the petitioners and others in order to rob the motorcycle of the husband of the informant, assaulted him who succumbed to the injury.

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general and admittedly the

Patna High Court Cr.Misc. No.41757 of 2015 (2) dt.09-10-2015 2/2 informant is not the eye witness of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioners in case the petitioners surrender within six weeks from today in connection with Khajauli P.S. Case No. 42 of 2015 pending in the court of learned J.M. Madhubani. This application is disposed of with the aforesaid observation/direction.
