03-03-2022 Heard learned counsel for the parties.

Petitioners pray for bail in Fulkaha P.S. Case No. 155 of 2020, registered for the offence under Section 394 of the Indian Penal Code.

As per the prosecution case, three miscreants riding on a Pulsar motorcycle intercepted the informant and snatched mobile phone, cash of Rs. 7,000/- and tempo from the informant.

It is submitted that name of the petitioners has transpired during course of investigation. During investigation, it has come that one Kapil Yadav is the owner of Pulsar

Patna High Court CR. MISC. No.68709 of 2021(2) dt.03-03-2022 2/2 motorcycle, which is alleged to be used in the aforesaid crime, and said Kapil Yadav is brother-in-law of petitioner no. 1 (Mukesh Yadav). Neither any incriminating / looted article has been recovered from the conscious possession of petitioners nor they were put on Test Identification Parade. Petitioners are in custody since 23.09.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Araria in connection with Fulkaha P.S. Case No. 155 of 2020.
