Petitioner is apprehending his arrest in connection with a case registered for the offence under Sections 109, 115 and 120(B) of the Penal Code. He is named in the First Information Report along with two others. Allegation against the petitioner and one Bhushan Paswan is similar. Bhushan Paswan has been allowed regular bail by the Sessions Judge under order dated 21.05.2015 passed in B.A. No. 751/15 (Annexure-2) after he remained in custody for about two weeks. Patna High Court Cr.Misc. No.41516 of 2015 (2) dt.16-10-2015 Sessions Judge submission was made that lower court may be directed to admit the petitioner to the privilege of bail but such prayer was refused giving reasons in Paragraph 8 of the order dated 24.06.2015 passed in A.B.A. No. 784/15.
Let petitioner, named above, surrender in the court below (Sri Prakash, Judicial Magistrate, 1st Class, Begusarai) within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter he be also allowed similar treatment as was allowed to coaccused Bhushan Paswan after he remained in jail custody for two weeks. Before admitting the petitioner to the privilege of bail in connection with Garhpura P.S. Case No. 17 of 2015, court below shall verify from the case diary that the allegation against the petitioner and said Bhushan Paswan is similar. Until such verification is made no coercive steps be taken against the petitioner.
