The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 307 and 120(B)/34 of the Indian Penal Code.

It is a case of assault and shot fire upon the informant by the two motorcycle borne persons. It is further alleged that the involvement of other accused Chandra Bhushan Prasad who is Mamera Jija of Amrita Sinha and Amrita Sinha was an earlier colleague of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has not been apprehended at the spot. He further submits that the location of mobile phone of

No.68961 of 2021(3) dt.02-03-2022 2/2 the petitioner was found near the place of occurrence ignoring the fact that the said location of the alleged mobile phone is dated 26.07.2021 in which it is alleged that on the said date there is no mobile trace location of the petitioner at the place of occurrence and only suspicion has been raised against the petitioner. Petitioner has got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna City (Patna) in connection with Daniyawan P.S. Case No. 99 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
