The appellants seek pre arrest bail in connection with Shikarpur P.S.Cae no.465 of 2015, registered for offences punishable under Sections 341, 323, 354(B), 504/34of the Indian Penal Code and section 3(i)(x) of SC/ST (Prevention of Atrocities) Act.
Allegation against the appellants is of abusing the informant by taking caste name. It appears that the cognizance has also been taken under the provisions of S.C./S.T. (Prevention of Atrocities) Act.
Submission of the learned counsel for the appellants is that there is absolutely nothing making out any case under
Patna High Court CR. APP (SJ) No.2224 of 2017 (2) dt.02-08-2017 2/2 S.C./S.T. (Prevention of Atrocities) Act against the appellant no.2 and 3 and further the police after investigation has submitted final form but differing with the report of the police, the cognizance has been taken. It is also submitted that earlier privilege of anticipatory bail had been granted to the accused persons, namely, Sandalika Dev, Ragini Kumari and Rani Kumari. Heard learned Special P.P. also.
Having heard both sides, this appeal is not maintainable, rather the appellants to surrender before the court of Special Judge and prayer for bail, who shall consider aforesaid aspect of the matter and shall dispose of the prayer for bail of the appellants, if possible on the same day without being prejudiced by the order of this Court.
With the above observation, this appeal is disposed of.
