2. The petitioners apprehend their arrest in connection with Bhagwanpur P.S. Case No. 243 of 2022 dated 14.10.2022 registered for the offences punishable under Sections 323, 325, 427, 307, 379, 504, 506, 34 of the Indian Penal Code.
3. The main submissions advanced by learned counsel appearing for the petitioners are that the instant matter relates to a free fight in between both the parties and the petitioners sustained injuries in that occurrence and their injury reports
Patna High Court CR. MISC. No.62505 of 2024(2) dt.08-10-2024 2/3 have been filed as Annexure- P/3 series and from prosecution side, informant and one, Saurav Kumar, are said to have sustained injuries. It is further submitted that on the person of the informant, three injuries were found which have been opined to be simple in nature though on the person of Saurav Kumar, one grievous injury has been found apart from two other simple injuries but the said grievous injury which was found on left foot, is not corroborating the allegation levelled against the petitioner no. 3 as he is alleged to have assaulted the said injured by the butt portion of a pistol. It is further submitted that there is one criminal antecedent against the petitioners but that mainly relates to an offence under Excise Act in which the petitioners have got bail.
4. Learned APP for the State has opposed the prayer for bail of the petitioners.
5. Considering the facts and circumstances of this case as well as above submissions and mainly petitioners' plea as to free fight having taken place in between both the parties and in this regard, the injury reports of both the parties filed with this petition are relevant, in my opinion, it is a fit case for anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest or surrender
Patna High Court CR. MISC. No.62505 of 2024(2) dt.08-10-2024 3/3 before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Bhagwanpur P.S. Case No. 243 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
