The petitioners seek bail in a case registered under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code. The prosecution case in short is that while the informant was sitting outside his door, the accused persons came there and assaulted his son with Lathi, Paina and rod.

It has been submitted on behalf of the petitioners that there is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 16-06-2019. The petitioner No. 1 is said to have assaulted upon the son of the informant. The nature of injury is said to be simple. So far

Patna High Court CR. MISC. No.54689 of 2019(2) dt.30-08-2019 2/2 petitioner No. 2 is concerned, he is said to have fired but the said firing did not hit anyone. No offence u/s 307 of the Indian Penal Code is made out.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 25 of 2019.
