JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-04-2017 The learned counsel, Mr. S.B.K.Manglam appearing on behalf of the petitioner submitted that although sufficient time was granted by the court to the petitioner to file application seeking permission to withdraw this election petition but because he is not in contact with the petitioner, no application could be filed during this period. According to the learned counsel, the respondents have got no objection, if the petitioner is permitted to withdraw this election petition.

Perused the record. It appears that in spite of repeated directions, no application has been filed but when the petitioner is seeking permission to withdraw this election petition, this court cannot compel the petitioner to prosecute this election petition. In view of the above facts and circumstances of the case, the petitioner is permitted to withdraw this election petition

Patna High Court E.P. No.1 of 2015 (27) dt.04-04-2017 and accordingly, this election petition is dismissed as withdrawn. No order as to cost.
