The petitioner is apprehending her arrest in connection with Baisi P.S. Case No. 07 of 2017 registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR and it appears that his name transpires in the confessional statement of co-accused. It has been submitted on behalf of the petitioner that due to election dispute this case has been lodged and all the contesting candidates to the post of Mukhiya have been made accused in this case and except confessional statement there is nothing against him.
Heard learned APP also, who has opposed the prayer for anticipatory bail.
Patna High Court Cr.Misc. No.36715 of 2017 (2) dt.18-08-2017 2/2 Having heard both sides and in view of the allegation, I am not inclined to grant anticipatory bail to the petitioner. Let petitioner surrender before the court below and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order, if possible, on the same day.
With the above observation, this application is dismissed.
