The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and Section 27 of the Arms Act. The informant named the petitioner along with other accused persons and alleged that they all made indiscriminate firing causing the death of his brother and one Rabindra Singh. It is submitted that the informant is not an eye witness of the occurrence. On account of litigation, the petitioner and other persons have falsely been implicated in this case. Similarly situated co-accused, namely, Munna Singh, Sonu Kumar, Kariman
Patna High Court Cr.Misc. No.42071 of 2015 (2) dt.11-09-2015 2/2 Singh, Prabhar Kumar have already been enlarged on bail by this Court vide Cr. Misc. No. 43380 of 2014 and Cr. Misc. No. 43875 of 2014 and the case of the petitioner stands exactly on the same footing.
Learned Additional Public Prosecutor did not dispute the aforesaid facts.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara in connection with Sahar P.
