The petitioner apprehends his arrest in connection with Morkahi P.S. Case No. 138 of 2016 registered under Sections 409 and 420 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that petitioner, being the Head Master of the School, has falsely been implicated in this case. The construction work could not be completed due to encroachment of the land. Further submission is that it would appear from Annexure nos. 1 to 6 that for removal of the encroachment, the petitioner gave several representations to the concerned authority, but nothing has been done and he is ready to return the defalcated amount.
