JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Dhansoin P.S. Case No. 67 of 2015 registered under Sections 341, 323 and 504 of the Indian Penal Code and 3(i) (x) S.C/S.T. (prevention of atrocities) Act.

The accusation is that mother of the informant was sitting at the door then the petitioner came in drunken state and started to abuse to mother of informant and caused injury on her right leg by bricks. When the informant and villagers reached there, the petitioner fled away.

Learned counsel appearing on behalf of the petitioner submits that in fact, the dispute arose due to drainage of

Patna High Court Cr.Misc. No.42696 of 2015 (2) dt.09-10-2015 2/2 water in Gali by the family members of the informant and petitioner, in which hot talk was exchanged. But the informant, who is a Scheduled Caste, filed this false case. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Buxar in connection with Dhansoin P.S. Case No. 67 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
