2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 103(1), 303(2) and 3(5) of the B.N.S..
3. The prosecution case, in brief, is that son of informant, namely Raja Paswan, was married with one Sangeeta Devi and both of them had two children out of the wedlock. However, Sangeeta Devi fell in love with one Pikesh Kumar Paswan and thereafter, son of informant started opposing the love affair. It is alleged that on 01.12.2024 at about 5 AM,

No.56779 of 2025(4) dt.04-11-2025 2/3 informant received information through mobile phone that his son has been murdered and when he reached the village, he saw dead body of his son with mark of rope clearly visible around the neck. Informant suspects that all the F.I.R. named accused persons, including these petitioners, have committed murder of his son. The reason for the occurrence is that the deceased was opposing the illicit relation of his wife with co-accused Pikesh Kumar Paswan.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Informant is not an eye witness of the alleged occurrence. The entire allegation is based merely on suspicion. Petitioners have falsely been implicated in this case merely because Petitioner No. 1 happens to be father-in-law, Petitioner No. 2 happens to be mother-in-law and Petitioner No. 3 happens to be brother-in-law of the deceased and there was a quarrel between the deceased and his wife. As a matter of fact, the deceased committed suicide. Even as per post mortem report, cause of death is Asphyxia due to hanging. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the
Patna High Court CR. MISC. No.56779 of 2025(4) dt.04-11-2025 3/3 petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, relationship between the parties and clean antecedents of the petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Madhepura in connection with Alamnagar P.S. Case No. 447 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S..
