JUSTICE SUDHIR SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 363, 366A and 504/34 of the Indian Penal Code. Allegation against the petitioner is to have kidnapped daughter of the informant for the purpose of marriage. It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 14.5.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner is said to have been falsely implicated in the present case. The alleged date of occurrence is 11.5.

2015 but the case was instituted on 13.5.2015. No explanation for the delay has been made by the prosecution. Medical report does not support allegation made in the F.I.R. It is further submitted that petitioner may be released after completion of nine months in custody from 14.5.2015. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

No.41921 of 2015 (3) dt.15-10-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of nine months in custody from 14.5.2015 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Terhagachh P.S. Case no. 67 of 2015.
