Petitioners apprehend their arrest in Athmalgola P.S. Case No.46 of 2019 registered under Sections 307, 379, 323 and other sections of the Indian Penal Code.

The informant made allegation against the petitioners that the petitioners wearing iron punch in their hands came after breaking the door of the house of the informant and assaulted the informant and his brothers with iron punch. Learned counsel for the petitioners submits that some altercation took place in a marriage party for which Complaint Case No.225 of 2019 was also registered in which the informant

Patna High Court CR. MISC. No.54001 of 2019(2) dt.28-08-2019 2/2 and others are accused. It is submitted that some scuffle took place but the informant lodged the case making exaggerated version. The injuries found on the injured are simple in nature. Having considered the facts and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, Patna in connection with Athmalgola P.S. Case No.46 of 2019 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
