JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-08-2019 This is an application for grant of anticipatory bail in connection with Buxar (M) P.S. Case No. 23 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation of recovery of 51.84 liters of liquor was recovered from the Khalihan of the petitioner and apart from that he is an accused in one more case of similar type. Submission of the learned counsel for the petitioner is that the Khalihan does not belong to the petitioner and he has falsely been implicated in this case.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground of maintainability and there is prima facie case against the petitioner.

Having heard both sides, in view of the allegation and the quantity of the liquor recovered from the Khalihan of the

Patna High Court CR. MISC. No.54581 of 2019(2) dt.30-08-2019 2/2 petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner.
