The petitioner is languishing in jail since 25.07.2015 in a case instituted under Sections 392, 120(B) and 411 of the Indian Penal Code.

As per prosecution case, it is a case of loot and snatching by the accused persons whereunder some cash and one mobile phone were looted from the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.07.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. There is no recovery of any incriminating article from the possession of the petitioner.

Patna High Court Cr.Misc. No.43759 of 2015 (3) dt.30-11-2015 Petitioner has not been put on test identification parade. Petitioner is not named in the FIR.

On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in connection with Katihar (Muffasil) P.S.Case No.57 of 2015.
