1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Falka P.S. Case No. 46 of 2023 registered under Sections 457, 380, 411, 413 and 34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive, village politics and grudge. Further submission is that the name of the petitioner has been dragged in this case merely on the confessional statement of co-accused Rohit Kumar. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in

No.60734 of 2023(2) dt.16-10-2023 2/2 the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Additional Chief Judicial MagistrateIII, Katihar in connection with Falka P.S. Case No. 46 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
