JUSTICE BIRENDRA KUMAR ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.
The allegation of commission of burn injury to the mother of the informant is against Dinesh Yadav, the father of the informant. Allegation against the petitioner, who is grandfather of the informant, is that when the informant went for rescue his mother the petitioner prevented her. The occurrence allegedly took place due to dispute between the spouses. Submission is that the petitioner is aged about 85 years and he is in custody since 15.06.2016.
Patna High Court Cr.Misc. No.49113 of 2016 (2) dt.21-12-2016 2/2 Considering the nature of allegation and the period already undergone by the petitioner, he is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad/Successor Court, in connection with Uphara P.S. Case No. 30 of 2016.
