The petitioner is in custody in a case registered under Section 394 of the Indian Penal Code.
The petitioner is not named in the FIR but during investigation the call-details of the petitioner were collected and he was arrested. Thereafter he made confessional statement disclosing the fact that he played role of liner and other coaccused committed the alleged crime. The learned Sessions Judge has mentioned in the impugned order that on the basis of disclosure made by the petitioner looted money was recovered from the possession of co-accused Vishal. So far recovery from the room of the petitioner is concerned, it is submitted that an
Patna High Court Cr.Misc. No.42231 of 2015 (2) dt.15-09-2015 2/2 amount of Rs. 12,000/- was recovered to which the petitioner claims that the aforesaid seized amount belongs to him. The petitioner does not have any criminal antecedent and is in custody since 12.07.2015.
Accordingly, the above named petitioner shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Saran at Chaapra in Marhaura P.S.Case No.242 of 2015.
