JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 24-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code.
It is alleged by the informant that cash of Rs. 37000/- and mobile phone of the informant was robbed by three unknown miscreants while he was going by his car to Goh. The accused persons also robbed the cash and other articles of other persons.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The petitioner is not named in the F.I.R and his name subsequently sprang up on the confessional statement of co-accused Vinay Paswan. A mobile phone is alleged to have been recovered from the petitioner but neither the said mobile nor the petitioner has been put on T.I.P till date. The petitioner is languishing in custody since 22.02.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S. Case No. 256 of 2021.
