Mr. Raj Kishor Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-09-2025 Heard learned counsel appearing on behalf of the petitioners and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 191(2), 190, 126(2), 115(2), 352 and 351(2) of the B.N.S. and Section 27 of the Arms Act.

3. The prosecution case, in brief, is that after measuring the land by Amin, a road was constructed by the local Mukhiya and Sarpanch. It is alleged that on 22.06.2025 at about 2 o'clock, these accused petitioners, along with six unknown persons, equipped with pistol, came there and started cutting the

Patna High Court CR. MISC. No.59304 of 2025(2) dt.01-09-2025 2/3 road by tractor and on protest, all of them threatened informant and his family members and started indiscriminate firing.

4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, on account of dispute with regard to path way, a simple scuffle took place between the parties and taking advantage of the situation, this false and concocted case has been lodged. Though there is allegation of indiscriminate firing but no one has sustained any fire arm injury.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and the fact that no one has sustained any fire arm injury, the prayer for grant of anticipatory bail to the petitioners is allowed.

7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in
