====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Ramkrishna Nagar P.S. Case No. 41 of 2014 dated 21.03.2014 instituted under Section 406 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against him is that he being a rickshawpuller had loaded certain books worth about Rs. 1,00,000/- of the informant for delivery at a place which was not done. Learned counsel submits that there was dispute between the petitioner and the informant

Patna High Court Cr.Misc. No.49098 of 2014 (2) dt.20-02-2015 2/2 due to which false case has been lodged and that there has been no recovery from him. It is further submitted that the informant knew the mobile number of the petitioner as he was regularly serving him in the past and he was also arrested on the basis of his location from the mobile and had he been guilty he would have taken precaution. It is submitted that the petitioner having clean antecedent is in custody since 19.06.2014.

Learned A.P.P. opposes the prayer for bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Judicial Magistrate, 1st Class, Patna in Ramkrishna Nagar P.S. Case No. 41 of 2014. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to do so on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
